Overview

Judge Jeremy C. Daniel granted preliminary approval of a $2,665,264.00 class action settlement in Smith v. Loyola University Medical Center, involving allegations of unauthorized data disclosure through healthcare website tracking technologies.

Smith v. Loyola University Medical Center 

ALG is pleased to announce that, on May 7, 2025, Judge Jeremy C. Daniel of the
United States District Court for the Northern District of Illinois granted preliminary
approval of a class action settlement in Smith v. Loyola University Medical Center, No.
1:23-cv-15828.

Plaintiffs Kensandra Smith and Mary Ellen Nilles, represented by ALG and co-counsel Chris Jennings, alleged that Loyola University Medical Center violated the privacy rights of its patients by utilizing tracking technologies that disclosed personal data to third parties without proper consent.

The Court found that the proposed settlement, which calls for establishing a fund of $2,665,264 to provide monetary compensation to affected individuals, met all the
necessary criteria for preliminary approval. In addition, Defendant will also provide non-
monetary benefits by stopping the use of tracking technologies without prominent
disclosures. A final approval hearing is scheduled for September 17, 2025.
