Court Grants Preliminary Approval of Class Action Settlement in Pixel Tracking Case Involving LifeMD

Overview
On June 4, 2025, a Nevada judge granted preliminary approval to a class action settlement in W.M.F. & Matthew Marden v. LifeMD, Inc., which, if finalized, will provide cash or vouchers to class members whose private information was allegedly disclosed to third-party AdTech companies via tracking tools on LifeMD’s websites.
Almeida Law Group is pleased to announce that on June 4, 2025, the Honorable Jennifer Schwartz, Eighth Judicial District Court Judge for Clark County, Nevada, granted preliminary approval of a class action settlement in W.M.F. & Matthew Marden v. LifeMD, Inc., Case No. A-24-906800-C.
If approved, the settlement will resolve claims that LifeMD, Inc. impermissibly disclosed class members’ private Information to third party AdTech giants such as Meta and Google through the use of tracking tools (commonly called pixels) on its websites. The settlement provides $10.00 in cash or a $25.00 voucher per class member. The Court conditionally certified a settlement class consisting of all persons residing in the United States that are or were members of LifeMD or RexMD or who ordered or purchased products from LifeMD or RexMD through the effective date of this Settlement Agreement and whose Private Information was allegedly disclosed to a third party using Tracking Tools on its websites.
In granting preliminary approval, Judge Schwartz appointed David S. Almeida, Founder and Managing Partner, of Almeida Law Group LLC and Nicholas A. Migliaccio and Jason Rathod of Migliaccio & Rathod LLP to serve as counsel on behalf of the settlement class. The final approval hearing is scheduled for September 30, 2025, at 9:00 a.m. in Department 17 of the Eighth Judicial District Court, Clark County, Nevada, located at 200 Lewis Avenue in Las Vegas, NV 89101.
