Court Denies Exer Urgent Care’s Motion to Dismiss in Privacy Class Action

Overview

The U.S. District Court for the Central District of California denied Exer Urgent Care’s motion to dismiss most claims in a privacy class action.

 Privacy Claims to Proceed

We are pleased to announce that, on January 30, 2025, Judge Amanda H. Anderson of the U.S. District Court for the Central District of California denied Exer Urgent Care’s motion to dismiss on all but one of Plaintiff’s claims. The putative class action lawsuit, captioned John Doe v. Exer Urgent Care, No. 2:24-cv-06099, involves allegations that Exer, a healthcare provider, used tracking technologies on its website to intercept and disclose users’ private health information to third parties such as Meta and Google.

 

Judge Anderson ruled that Plaintiff stated viable claims under several privacy and consumer protection laws including the Electronic Communications Privacy Act, the California Invasion of Privacy Act, and the California Confidentiality of Medical Information Act.
