Preliminary Approval Granted in Health Data Privacy Settlement Against University of Rochester

Overview

A federal court has preliminarily approved a class action settlement against the University of Rochester over allegations that it improperly shared sensitive health information with Facebook through tracking technology on its websites.

On April 10, 2025, Judge Mark W. Pedersen of the United States District Court for the Western District of New York granted preliminary approval of a class action settlement in Kane v. University of Rochester, No. 6:23-cv-06027.

Plaintiffs, represented by court-appointed co-lead counsel David S. Almeida of Almeida Law Group LLC and James J. Bilsborrow of Weitz & Luxenberg, PC, brought suit against the University of Rochester, alleging that sensitive health information was improperly shared with Facebook through the University’s use of the Facebook Pixel on its web properties.

The proposed settlement provides monetary relief to class members whose data was compromised, covers administrative costs and attorneys’ fees, and includes service awards for the class representatives. The Court found the settlement to be fair, reasonable, and adequate under Federal Rule of Civil Procedure 23.
