Whenever we go online, whether it is to shop, bank or use social media. our confidential personal data is captured—often instantaneously and without our knowledge or consent— by many companies. It is their responsibility to safeguard our data and protect it from being stolen and used illegally. However, in today’s rapidly changing digital environment, data breaches are an almost daily occurrence. Companies sometimes also harvest user data to serve their own purposes, without consent from their customers. These potentially illegal practices raise many troubling concerns, including fraud, invasion of privacy and identity theft.

Many companies—in order to get an advantage over their competitors or for other reasons—take advantage of consumers by fraudulently or deceptively attributing qualities to their products that do not exist. Or they do not inform consumers that their products contain potentially harmful ingredients. These issues are particularly acute for health products and those for infants and toddlers.

We are litigating several cases on behalf of small businesses victimized by predatory lending practices, including so-called merchant cash advance programs whereby lenders purport to “advance” money to small businesses based on their projected income. In reality, these transactions are often loans by another name and the lure of “fast cash” usually turns in a nightmare as the lenders charge criminally usurious interest rates, impose unconscionable fees and do everything possible, legal and otherwise, to ensure that these supposedly non-recourse advances are paid back in full, with interest and fees.
