ALG Secures Motion to Dismiss Victory Against Onnit Labs in Video Privacy Lawsuit

On May 14, 2025, U.S. District Judge David A. Ezra denied Onnit Labs’ motion to dismiss a class action lawsuit alleging the company violated the Video Privacy Protection Act by sharing users’ Facebook IDs and video viewing histories with Meta without consent.

ALG is pleased to report that on May 14, 2025, U.S. District Judge David A. Ezra of the Western District of Texas issued a decision denying Onnit Labs, Inc.’s request to dismiss a consumer privacy class action lawsuit asserting violations of the Video Privacy Protection Act (VPPA).

The case, MacAlpine v. Onnit Labs, Inc., No. 1:24-cv-00933-DAE, centers around Onnit Labs’ alleged use of tracking technology on its website, which allegedly disclosed consumers’ Facebook IDs and the titles of videos they purchased to Meta without consent. Plaintiffs, represented by Matthew Langley of Almeida Law Group LLC and Frank Hedin of Hedin LLP, contend that this disclosure of personally identifiable information violates the VPPA, a federal privacy law designed to protect consumers’ video viewing history.

In his decision, Judge Ezra found that plaintiffs plausibly alleged Onnit Labs knowingly disclosed personally identifiable information to Meta. In so doing, he rejected Onnit Labs’ argument that such disclosures did not qualify as personally identifiable information under the VPPA, emphasizing the significance of Facebook IDs as identifiers linking individuals directly to their viewing histories.

With this ruling, Plaintiffs are one substantial step closer to achieving justice for themselves and the class of similarly situated individuals they represent.
